Supreme Court Rejects Microsoft Appeal in Eolas Case

Why are they being fucked?

Apparently the founder of Eolas owns a patent on "a system allowing a user of a browser program ... to access and execute an embedded program object." Too bad, Microsoft should have got Slashdot on the case, they would have found prior art! Laughing

I don't have much opinion on whether or not they deserve to lose money over anything (the cost of business today is not hard work, it's hard working lawyers) but I'm not real happy that they lost. Because it upholds this entirely too broad junk patent, which will only make things worse for everyone. Sad

Some of these patents are completely absurd if not vague and ambiguous. The patent dept. in the US needs to really evaluate how they go about awarding patents.

I don't know what the actual description of the patent is (beyond what I quoted above), and it's unwise to base one's opinion on that little snippet alone, but seriously, what does that mean? What is Java then? Or what is Macromedia Flash/Shockwave? What does MS have to do with this more then anyone else? I don't get it.

It's like the other absurd patent lawsuits that have been thrown about the last many months. Creative, MS, Apple, they're all guilty of this. So the way I see it, either the corporations start to lobby for better patent scrutiny, or THEY keep suing each other for the lamest 'patents' and get what they deserve in the end.

Personally, I don't care, which is why I voted for 'I don't care', and to show that the polls here on OSY does work.

They mad ea browser that allows other programs to be embedded within it, which is what violates the patent as far as I am aware. In the very worst case scenario, they are able to go after macromedia etc. but in such a case it makes the most sense to go after MS, because they've got the fat cash, and then pick off any others they can get to.

The Eolas case really explains why Microsoft has been so crazy to get as many software patents as they can over the last few years. If they don't, they'll just end up bleeding billions of dollars to any two-bit outfit with a lawyer.

Agreed. I'm not at all sold on the idea of the "software patent".

Although, if I have to work in the system, what I need to do is go back in time, and patent the linked list. Then I could sue EVERYBODY.
